Property Referral Programme terms

These terms and conditions of the Property Referral Programme are made available by Booking.com to and for the benefit of the Accommodations that are eligible for and interested in joining the Property Referral Programme (at all times on a voluntary basis through opt-in (subject to the conditions set out in these terms)) (the “Property Referral Programme” or the “Programme”).
  1. Definitions and interpretations
    • Unless defined otherwise in these Property Referral Programme terms (the “Programme Terms”), capitalized terms have the same meaning as set out in the Accommodation Agreement entered into between the Accommodation and Booking.com (the “Agreement”).
    • Except as otherwise provided for herein, the terms and conditions of the Agreement remain unchanged and in full force and effect.
  2. The Property Referral Programme
    • Booking.com’s Property Referral Programme is an incentive programme for eligible Accommodations. Eligible Accommodations can save on Commission (see Incentive section below) by referring first time, new accommodations (“Referred Accommodations”) who register on the Platform and successfully complete bookings.
    • Booking.com will make available to each eligible Accommodation a unique link allowing the Accommodation to initiate referral of Referred Accommodations (the ‘Referral Link’).
  3. Eligibility
    • The Accommodation (at least) needs to fulfill the following criteria in order to be eligible for the Programme:
      • The Accommodation must be registered and open and available for bookings (‘open bookable’) on the Platform.
      • The Accommodation is located in Australia, Italy, Germany, France, Spain, United Kingdom or the United States.
    • The Referred Accommodation needs to fulfill the following criteria in order to be eligible for the Program:
      • The Referred Accommodation is located in Australia, Italy, Germany, France, Spain, United Kingdom or the United States.
      • The Referred Accommodation is a new business partner of Booking.com and is registering the Accommodation(s) (meaning propert(y)/(ies)) for the first time on the Platform and has been invited to join the Property Referral Programme via an Referral Link shared by an Accommodation and accepts the Terms during registration process. No previous registration of the Referred Accommodation can exist at the same address nor any other property ID in any status.
      • The Referred Accommodation needs to be registered and is open and available for bookings (‘open bookable’) on the Platform within 30 days after starting their registration process.
      • The Referred Accommodation must complete a booking, which means the Guest check-in date must be within 90 days after becoming ‘open bookable’. Bookings that are canceled or where the Guest is a no-show, even if Booking.com already charged the Referred Accommodation Commission, are not considered to be completed bookings. The Guest may not be in any way (directly/indirectly) related or connected to the Referred Accommodation or Accommodation, e.g. by blood, family, colleague or friendship.
      • The Referred Accommodation must initiate registration on the Platform via a Referral Link. In case of a dispute Booking.com has the right to unequivocally determine whether or not this is the case.
      • The registration of the Referred Accommodation and the booking must be completed while the Programme is active.
    • Booking.com reserves the right to verify the information provided by the Accommodation and the Referred Accommodation to verify its truthfulness and accuracy, in order to establish eligibility for the Program.
  4. Incentive
    • If the Accommodation and the Referred Accommodation are eligible for the Programme (see Eligibility section above), the Accommodation and the Referred Accommodation can each receive a maximum of 5 Commission-free bookings (the ‘Incentive’).
    • The maximum amount of the Incentive is EUR 200 (or the local equivalent of this amount).
    • The Incentive applies to Commission only and does not apply to payment processing or handling fees for guest payments or other payments.
    • After the Accommodation or Referred Accommodation reach the maximum Incentive amount, the Accommodation or Referred Accommodation will be subject to the standard Commission levels as defined by Booking.com.
    • The Incentive will be shown on monthly invoices issued to the Accommodation by Booking.com as a credit note on the total amount of the invoice.
    • Accommodation rules for receiving the Incentive
    • The Accommodation is only eligible to receive the Incentive within 90 days as of the first reservation at the Referred Accommodation. For the Accommodation, the qualifying bookings will be the first 5 successfully completed and stayed (bookings that are canceled or where the guest is a no-show do not qualify as completed booking) bookings in chronological order, based on check-in date.
    • The Accommodation can refer up to a maximum of 10 Referred Accommodations with its Referral Link. Regardless of other criteria, the maximum total saving on Commission for the Accommodation is EUR 2000 (or the local equivalent of this amount).
    • If the Accommodation has multiple referrals active at the same time, Booking.com will select the first 5 bookings (or less if Commission reaches the maximum as set out in section 4.2) based on check-in date.
    • Referred Accommodation rules for receiving the Incentive
    • For the Referred Accommodation the qualifying bookings are the first 5 successfully completed and stayed bookings in chronological order, based on check-in date. The Referred Accommodation is only eligible to receive the Incentive for completed and stayed bookings within the first 90 days after becoming open bookable.
  5. Miscellaneous
    • The Accommodation may only advocate, market, promote, publish and/or share the received communication (including any Referral Link) within its personal (private) network. The Accommodation is not allowed to (directly/indirectly) (actively) market, publicly publish or promote the Programme and/or the invite (including any Referral Link) on any third-party platform (including Google Ads, Reddit, eBay, Amazon etc) or via branded materials. The Accommodation may publish and include the Programme and received communication (including the Referral Link) on your personal account on Facebook, LinkedIn, Instagram, etc. The Accommodation is not allowed to act in any manner that implies that it is authorized to bind Booking.com, nor is the Accommodation allowed to present itself as an employee, intermediary, agent or consultant. The Accommodation shall not imply an agency relationship between Booking.com and the Accommodation.
    • The Accommodations are not allowed to share or publish the Referral Link where there is no reasonable basis for believing that recipients appreciate the invitation stated through the Referral Link, and not in violation of applicable anti-spam laws.
    • In the event of (alleged) fraud, misuse or violation of the Agreement or these Terms, Booking.com is entitled to immediately suspend or terminate the Agreement with the relevant Accommodation and/ or withhold any payments and/or incentives.
    • Booking.com may in its sole discretion decide to stop offering the Programme to Accommodations and Referred Accommodations or to modify the Programme. Booking.com may at any time at its sole discretion for any reason decide to exclude any Accommodation or Referred Accommodation from participation in the Programme.
    • The Accommodation is solely responsible and liable for payment, withholding, remittance and reporting of any taxes, levies, imports, duties, charges, fees and withholdings, that may arise from participation in the Programme (including corporate/individual income tax, VAT, sales taxes and such other applicable national, governmental, provincial, state, municipal or local taxes or levies and associated late payment interests and penalties imposed by any authority for failure to pay, withhold and report).
    • These Programme Terms (i) may be unilaterally amended or supplemented from time to time by Booking.com in its sole discretion subject to a reasonable notice period to the relevant participants, (ii) are and form an integral part of the Agreement (as applicable) (including the General Delivery Terms as amended from time to time), and must be read in conjunction therewith, and (iii) may be accepted online, but in any event apply pursuant to the opt in and use of the Programme by the Accommodation. In case of conflict between the terms of the Agreement and these Programme Terms, these Programme Terms prevail.
